Terms of Service

These Terms of Service (“Terms”) govern your use of the Appetell platform, including the website at appetell.com, the Appetell dashboard, the Appetell client application, and all related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms.

Appetell is operated in the United States. The Service is currently available to US-based restaurants only.

1. Service Description

Appetell provides an AI-powered phone ordering system for restaurants. The Service includes:

  • An AI agent that answers phone calls and takes orders through natural conversation
  • A web dashboard for managing restaurant configuration, menus, orders, call history, and billing
  • A desktop client application (the “Appetell Client”) that connects to thermal printers to print order tickets
  • A dedicated phone number assigned to your restaurant for receiving orders

The AI agent is not a human. Callers interact with an automated system. While we strive for high accuracy, the AI may occasionally misunderstand or misprocess orders.

2. Account Registration

To use the Service, you must create an account using a valid email address. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old and have the authority to bind your business to these Terms.

3. Free Trial

New customers may be eligible for a 15-day free trial with 100 minutes of included call time. Each customer is limited to one free trial. Usage beyond the included minutes during the trial period will be billed at the standard per-minute rate. A valid payment method is required to start the trial. Your card will not be charged during the trial period unless you exceed the included minutes.

4. Subscription and Billing

After the trial period (or if not eligible for a trial), the Service is billed as follows:

  • Monthly subscription fee: $149 per month per restaurant
  • Usage fee: $0.39 per minute of call time, rounded up to the nearest minute per call

Billing is processed through Stripe. By subscribing, you authorize automatic monthly charges to your payment method on file. Subscription fees are non-refundable. Usage charges are billed based on actual call duration.

5. Cancellation

You may cancel your subscription at any time through the dashboard. Upon cancellation:

  • Your service will continue until the end of the current billing period
  • No prorated refunds are issued for partial billing periods
  • After the billing period ends, your restaurant configuration and associated data will be permanently deleted
  • You may resubscribe before the billing period ends to prevent deletion

6. Call Recording and Transcription

All calls handled by the Appetell AI agent are recorded and transcribed. By using the Service, you acknowledge and agree that:

  • All inbound calls to your Appetell phone number will be recorded
  • Call recordings and transcripts are stored and accessible through your dashboard
  • You are responsible for complying with applicable call recording laws in your jurisdiction, including providing appropriate notice to callers where required
  • Sentiment analysis is performed on calls to provide quality insights

We recommend including a recording disclosure in your AI greeting message or informing callers through other means as required by your local laws.

7. Data and Content

You retain ownership of your restaurant data, including menus, order history, and configurations. You grant Appetell a limited license to use this data solely to provide and improve the Service.

You are responsible for the accuracy of the menu information you provide. Appetell is not liable for errors in orders caused by inaccurate menu data.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to interfere with or disrupt the Service
  • Reverse engineer any part of the Service or the Appetell Client
  • Share your API keys or account credentials with unauthorized parties
  • Use the Service to process orders for products or services other than food and beverage

9. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, Appetell shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost orders, or business interruption, arising from your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid to Appetell in the 12 months preceding the claim.

11. Third-Party Services

The Service relies on third-party providers for certain functionality. By using the Service, you acknowledge that your data may be processed by these providers in accordance with their respective terms and privacy policies:

  • Retell AI — telephony, call recording, and speech processing
  • Anthropic — AI language model for order processing
  • Stripe — payment processing and subscription management
  • Amazon Web Services — cloud infrastructure and data storage
  • Clerk — user authentication

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the dashboard. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Sections relating to liability, data, and dispute resolution survive termination.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in the courts of the applicable jurisdiction.

15. SMS Verification Program

Appetell operates an SMS verification program through our messaging provider, Twilio. The following terms apply to any verification SMS you receive from us:

  • Program name: Appetell Verification SMS
  • Description: One-time passcodes sent to confirm phone ownership for loyalty rewards account sign-in and for demo phone-call requests initiated from our marketing site.
  • Opt-in: You opt in by entering your phone number on appetell.com and tapping the “Send code” button. For the demo-call flow, you must additionally tick the TCPA consent checkbox. You cannot opt in by texting a keyword.
  • Message frequency: One message per verification request you initiate. There is no recurring or scheduled messaging.
  • Message and data rates: Standard message and data rates may apply per your mobile carrier plan.
  • Opt-out: Reply STOP to any verification message to unsubscribe. You will receive one final confirmation message and no further verification SMS thereafter; you may opt back in by entering your number on appetell.com again.
  • Help: Reply HELP for support information, or email questions@appetell.com.
  • Supported carriers: All major U.S. wireless carriers (AT&T, T-Mobile, Verizon, US Cellular, and others). Appetell is not liable for delayed or undelivered messages.
  • Privacy: Phone numbers used for verification are handled in accordance with our Privacy Policy.
